ITC Issues General Exclusion Order for Certain Lexmark Toner Cartridges

In September, the International Trade Commission issued a notice to terminate the investigation in Certain Toner Cartridges and Components Thereof (Inv. No. 337-TA-740) with a finding of a violation of Section 337. The Commission further determined to issue a general exclusion order (GEO) and cease and desist orders (CDOs). A GEO prohibits the unlicensed entry into the U.S. of toner cartridges and components that infringe certain claims of the asserted Lexmark patents by any company. CDOs are directed at the domestically-based respondents that defaulted and foreign-based defaulting respondents which produce the same result in that these companies cannot import or sell the affected products into the United States either.  In the world of ITC complaints this decision by the ITC could be viewed as a “slam dunk.”  Read more »

Toshiba Takes It All In

Toshiba America Business Solutions Inc.’s “Zero Waste to Landfill” recycling program has done quite well with a 410% increase from last year. Now, the company has decided to accept imaging consumables from other manufacturers, virtually unheard of in the industry. All vendors do receive items that do not belong to them but it isn’t encouraged or accepted. This is where Toshiba is different by willingly taking everyone’s empty supply items. Toshiba is positioning itself as the vendor that makes it very easy for their customers to participate in a supplies recycling program. With many businesses adopting MPS (Managed Print Services) programs often with multiple vendors covered, this return program will make it much easier for customers to participate without consideration to vendor and having to separate out the various cartridges.

Clover Acquires ERS

There has been a flurry of acquisition activity this week in the aftermarket. First, Katun acquired Media Sciences’ toner business and now Clover has acquired broker, Environmental Reclamation Services (ERS). According to the press release from November 15, 2010, Clover Holdings, Inc., the largest aftermarket remanufacturer, acquired ERS but both companies will continue to operate independently servicing their customers. Founded in 1990, ERS is headquartered in Erie, PA and is a global provider of environmental solutions including recycling and the collection of printer supplies and small electronics. ERS is one of the biggest companies of its kind processing over 70 million units since inception and had been owned by Falcon Investments since March 2007. The other large broker similar to ERS would be Greentec (Ontario, Canada). Read more »

Media Sciences Sells its Toner Business to Katun

On November 12, 2010, Media Sciences International sold its toner business to Katun Corporation, a Monomoy Capital Partners portfolio company that was acquired in September 2008. Katun purchased assets used in the Media Science’s toner business including inventory, fixed assets, and intangibles such as business name and trademarks, for approximately $11 million. The final amount will be determined based on the value of the inventory 30 days from closing which is still to be determined. Katun will also assume the liability for all unfulfilled purchase orders, for a defined amount for returns and allowances, and for any post-closing liabilities under all customer and vendor contracts for the toner business but not for any of Media Sciences other liabilities. As part of this transaction, Katun will also become the exclusive Master Distributor of the Media Sciences solid ink products for use in Xerox color printers for a period of three years. The two companies also entered into a license agreement that allows Media Sciences and its affiliate to continue using its business name and several websites for up to two years. Read more »

Canon Continues Legal Attack to Protect Supplies Around the World

The past few months have been pretty busy for Canon as they seek to protect their supplies in a big way. In May 2010, Canon filed several complaints with the Korean Trade Commission regarding its photosensitive drums used in printing equipment. Separately, at the end of June, Canon filed a complaint with the USITC (United States International Trade Commission) and a concurrent, separate lawsuit in district court regarding two patents covering the printer’s drive motor connection with the OPC drum in the toner cartridge. (See separate blog, Canon Sues Ninestar and Others Over Toner Patents,” from June 30, 2010 ) For some time, many industry watchers were wondering if there was going to be any action regarding the increased activity in new build, compatible toner cartridges especially for HP/Canon laser printers.
